Using another user's account information to access the services is strictly prohibited. Your right to use this website is personal and non-transferable to any other person or entity. You are responsible for safeguarding the confidentiality of your passwords and other registration information. You are fully responsible for all activities that occur under your account.  The website offers a specific service that allows telecommunication with astrologers who are registered and affiliated with the website. By agreeing to these current Terms of Usage, you also grant your unequivocal consent to the website for arranging a phone call with you on your mobile number, even if your number is registered on the Do Not Disturb (DND) service provided by your mobile service provider.

The Website and the Service Providers providing advice are not liable for any expected results, and user access to the Website is at their own risk.

By using the Site, Application, or Services, users agree that any legal remedies or liabilities sought for actions or omissions of other Members, including registered service providers and third parties linked with the Website, shall be limited to claims against the responsible party. Users agree not to hold the Website liable for such actions or omissions.

   BREACH AND TERMINATION

The Website reserves the right, without prior notification to the User, to modify, discontinue, change, or alter the services that have been ordered or the User's registered Account. The Website may or may not provide notice or a reason for taking such actions.

Any violation of the terms and conditions outlined in this Terms of Usage may result in the immediate cancellation of the User's registration with the Website. The Website retains the right to terminate and take prompt action if:

1. The Website cannot verify or authenticate the User's registration data or any other relevant information provided.
2. The Website believes that the User's actions may lead to legal liability for the Website, other Users, or any service provider associated with the Website.
3. The Website believes that the User has supplied false or misleading registration data, or if there is interference with other Users or the administration of the services, or a breach of the Website's privacy policy.

Regarding service providers, including Astrologers, it is understood and agreed that the relationship with the Website is limited to being a member, and the service provider acts exclusively on their behalf and for their benefit. The Website may terminate and deactivate the profile of such a service provider for any violation of the current terms of usage and the Service Terms and Conditions agreed upon during registration.

Policy for Service Returns and Cancellations

A request for a refund for a Paid Service may be initiated under the following circumstances:

1. If a Registered Member experiences network issues that disrupt the consultation chat/call, such as a weak signal, background noise, or an inaudible consultant during video/normal call sessions.
2. If the Astrologer is unable to communicate clearly in the language specified in their profile.
3. If a Registered Member is dissatisfied with the quality of advice or consultation provided by an Astrologer. In such cases, the initiation of a refund is subject to review and approval by Astroashram, regarding the consultation or advice's quality. Astroashram's decision on this matter will be final and not open to challenge. Any dissatisfied Registered Member can contact us about such issues by writing to us at support@astroashram.

No refund will be provided under the following circumstances:

1. If the request for a refund is initiated by the Registered Member two hours after the payment time. However, if payment has been accidentally made twice for the same Service, the subsequent payment amount will be automatically refunded.
2. If the information provided by the Registered Member on the Website is found to be incorrect.
3. If customers have received a consultation report or have used the Service through other electronic means.
4. If an incorrect phone number is provided while availing of telephonic Services.
5. If the consultation with an Astrologer has already commenced.

USER RESPONSIBILITIES

All Users, including astrologers and member customers, are obligated to adhere to the privacy policy, terms and conditions, and any other stipulated terms on the Website. Users represent themselves as individuals and not as corporations or legal entities. The right to use the Website's services is strictly personal to each User.

While using the Website and engaging in any form of communication, including on the Website's listed products and forums, Users must not violate the terms and conditions, which include:

1.     Users must not post, publish, or transmit any messages that are false, misleading, defamatory, harmful, threatening, abusive, harassing, invasive of privacy, offensive, promoting racism, hatred, or harm towards any individual, group, religion, or caste, or infringing on another's rights, including intellectual property rights, copyright, or trademark. Users must also refrain from violating any applicable laws or regulations.

2.     Users must not upload, post, or make available any content that they do not have the right to share, whether it's due to legal requirements or contractual or fiduciary relationships.

3.     Users must not upload, post, or make available any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party. Posting excerpts of copyrighted material is allowed as long as it adheres to Fair Use guidelines.

4.     Users must not collect screen names and email addresses of registered members on the Website for the purpose of advertising, solicitation, or spam.

5.     Users must not send unsolicited email, junk mail, spam, chain letters, or promotions/advertisements for products or services.

6.     Users must not upload or distribute files containing viruses, corrupted files, or any other software or programs that may harm the Website's operation or another user's computer.

7.     Users must not engage in activities that disrupt or interfere with access to the Website.

8.     Users must not attempt unauthorized access to any part of the Website, other connected systems or networks, or any services offered on the Website through hacking, password mining, or other illegitimate means.

9.     Users must comply with all applicable laws and regulations, both within and outside India, when using the Website's services, which are intended for personal use.

10.  Users must not resell or commercially use the Services without express written consent from the Website.

11.  Users must not violate these Terms of Usage, including any additional terms found on the Website.

12.  Users must not reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website.

By becoming a registered member of the Website, Users agree to receive communications through the app/website via email, SMS, or any other communication medium, including WhatsApp Business Messages, related to the app/website's usage.

Users must not transmit unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or objectionable material through the Website. Transmitting material that encourages criminal conduct, civil liability, or violations of local, state, national, or international laws and regulations is strictly prohibited. Unauthorized attempts to access other computer systems are also not allowed.

Users must not interfere with other members' use or enjoyment of the Website or Services.

Users have an obligation to report any misuse or abuse of the Site. If Users observe any abuse or misuse of the Site that violates this Agreement, they must report it to Website Customer Care. Upon receiving such a complaint, Website may investigate and, if necessary, terminate the membership of the responsible Member for such violations, abuse, or misuse without any refund of the subscription fee.

Any false complaints made by a Member may result in the termination of their membership without a refund of the subscription fee.

The Website reserves the right to withdraw its services from any customer found to be acting unreasonably or abusively during their conversation with the Service Provider, including astrologers, regardless of the reason.

While the Website will take all necessary steps to address situations that violate the above obligations, if the situation remains uncontrollable, the Website reserves the right to issue a written warning. Repeated violations by a User will result in a complete ban from transacting on the platform. If a User has a balance in their wallet, it may be refunded, subject to any applicable charges for such violations.

                                BANK ACCOUNT INFORMATION

The User is required to provide their banking information when requested. In this regard, the User's obligations are as follows:

1.     The User acknowledges that the debit/credit card details provided for the use of the aforementioned Service(s) must be accurate and belong to the User, and the User shall not use a debit/credit card that they do not lawfully own or for which they do not have authorization from the lawful owner. The User also agrees and commits to providing accurate and valid debit/credit card details.

2.     The User may make the required fees payment to the Website using a debit/credit card or online banking account. The User warrants, agrees, and confirms that when initiating a payment transaction or issuing an online payment instruction and providing card/bank details:

a. The User has full and lawful entitlement to use the credit/debit card and bank account for such transactions.

b. The User is responsible for ensuring the accuracy of the card/bank account details provided.

c. The User is responsible for ensuring that there is sufficient credit available on the nominated card/bank account at the time of payment to cover the dues or bills selected by the User, including the applicable fee.

3.     Furthermore, the User agrees that if any part of these Terms of Usage is determined to be invalid or unenforceable under applicable law, including, but not limited to, warranty disclaimers and liability limitations as set forth herein, the invalid or unenforceable provision will be replaced by a valid and enforceable provision that best reflects the original provision's intent. The rest of these Terms of Usage shall remain in effect.
